Questions

Frequently asked questions.

Can foreign nationals buy real estate in Türkiye?+

In general, yes. Foreign individuals may acquire real estate in Türkiye subject to the conditions of the Land Registry Law, including area limits, restrictions in military and security zones and certain country-specific rules. Title transfers take place at the land registry office, and a valuation report is required for purchases by foreign nationals.

On what grounds can a tenant be evicted?+

Only on the grounds set out in the Turkish Code of Obligations. These include the genuine need of the landlord or close family members for the property, major renovation or reconstruction, a written eviction undertaking given by the tenant, and two justified written warnings for late payment within the same lease year. For most eviction claims, mediation must be tried before a lawsuit is filed.

How are rent increases determined for residential leases?+

Under the Turkish Code of Obligations, annual rent increases for residential leases may not exceed the twelve-month average change in the consumer price index (CPI). After five years of tenancy, the rent may be redetermined according to market conditions by agreement or through a rent determination action.

What does a shareholders’ agreement usually cover?+

Typical provisions include restrictions on share transfers (such as pre-emption, tag-along and drag-along rights), board composition, matters requiring special approval, dividend policy, deadlock resolution and exit mechanisms. The agreement should be consistent with the company’s articles of association.

Can a foreign national set up a company in Türkiye?+

Yes. Under the Foreign Direct Investment Law, foreign investors may establish companies on the same terms as Turkish investors. The most common forms are the joint stock company (A.Ş.) and the limited liability company (Ltd. Şti.). Both are registered with the trade registry and are subject to the statutory minimum capital requirements.

Does a company website need a KVKK privacy notice and cookie consent?+

In most cases, yes. A website that collects personal data, for example through contact forms or analytics tools, must inform visitors under Article 10 of the KVKK. According to the Personal Data Protection Authority’s cookie guidance, cookies other than those strictly necessary for the site to function generally require the visitor’s explicit consent before they are placed.
